By accessing or using the services provided by Ostris, LLC (“Ostris, Paint Me AI,” “we,” “us,” or “our”), including our generative image services, website, and any other related services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our services.

2. Service Description:

Ostris provides generative image services, allowing users to create and manipulate images through AI technology. Our services are subject to change or discontinue at any time without prior notice.

3. User Conduct:

You agree to use our services only for lawful purposes and in a way that does not infringe the rights of or restrict or inhibit the use and enjoyment of this service by any third party. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our services.

The content and technology used in our services are the property of Ostris or our licensors and are protected by intellectual property laws. You may not use such content or technology without our express written consent.

5. User-Generated Content:

You retain all rights to the images and content you create using our services. However, by creating content, you grant Ostris a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such content in connection with our services.

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

7. Limitation of Liability:

Ostris shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

8. Indemnification:

You agree to indemnify and hold harmless Ostris and its officers, directors, employees, and agents from any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of and access to the service, or from the violation of these Terms.

9. Modification of Terms:

We reserve the right to modify these Terms at any time. We will provide notice of any changes either by posting a new version or by sending you a notification. Your continued use of the service after any such change constitutes your acceptance of the new Terms.

10. Termination:

Ostris may terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

11. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of Colorado, USA, without regard to its conflict of law provisions.
